The Cost? There is absolutely no charge for Fulton Savings Express Online and Express Bill Pay service.

We at Fulton Savings have worked hard to make Express Online Banking plain and simple. Once you start the process using your personal computer (PC) and an internet connection to our secure server, Fulton Savings Express Online Banking will lead you through the process and change the way you do personal banking - forever.

All you need is an account at Fulton Savings Bank, a PC and Internet access with the latest browser version available. Once you start the process using your PC and an internet connection to our secure server, Fulton Savings Express Online Banking will lead you through the process and change the way you do personal banking forever.

Once you are established with our Online Banking Department, you will be able to add our Express Bill Pay feature. Simply select the payee tab, click add payee and follow the prompts. That way you will be able to pay your bills, as well as do your personal banking, from the convenience of your computer.

By using the Express Online Banking Services, you agree to the terms and conditions of this Access Agreement. This Express Online Access Agreement will be governed by and interpreted in accordance with Federal law and regulation, and to the extent there is no applicable Federal law or regulation, by the laws of the State of New York. The terms "we," "us," "our," "Fulton Savings Bank," and "Bank" refer to Fulton Savings Bank. "You" refers to each signer on an account. The term "business days" means Monday through Friday, excluding Saturday, Sunday and Federal holidays. Express Online Banking can be used to access Fulton Savings Bank accounts. Each of your Fulton Savings Bank accounts is also governed by the applicable account disclosure statements ("Account and Service Agreement").

By signing up for Express Bill Pay, I / We authorize Fulton Savings Bank to post payment transactions I / we generate by Express Bill Pay. I/We understand that I / we are in full control of my/our account. If at any time I / we decide to discontinue service, I / we will provide written notification to Fulton Savings Bank, 75 South First Street, Fulton, NY 13069, Attn: On-line Banking Department.

My/Our use of Express Bill Pay signifies that I/we have read and accepted the terms and conditions governing the service. I / We understand that payments may take up to seven (7) business days to reach my / our selected vendors and that they will be sent either electronically or by check.

Fulton Savings Bank or its authorized agent will use reasonable efforts to ensure payments reach creditors on time but cannot guarantee the time a payment will be posted by a creditor. Fulton Savings Bank or its authorized agent will use reasonable effort in ensuring creditors reverse any service fee or late charge that is related to a payment processing error. Fulton Savings Bank is not liable for any service fees or late charges levied against me / us by my / our vendors. I / We also understand that I / we are responsible for any loss or penalty that I / we may incur due to a lack of sufficient funds or other conditions that may prevent the withdrawal of funds from my / our account.

I/We acknowledge that there will be an insufficient funds fee or a stop payment fee (if applicable). Please refer to Fulton Savings Bank schedule of fees for current charges.

In order to use Express Bill Pay, you must be a checking account customer of Fulton Savings Bank.


Introduction

This Online Access Agreement ("Access Agreement") for accessing your Fulton Savings Bank accounts through Express Online Banking explains the terms and conditions governing the Online banking services and bill pay offered through Express Online Banking. By using the Express Online Banking Services, you agree to the terms and conditions of this Access Agreement. This Express Online Access Agreement will be governed by and interpreted in accordance with Federal law and regulation, and to the extent there is no applicable Federal law or regulation, by the laws of the State of New York. The terms "we," "us," "our," "Fulton Savings Bank," and "Bank" refer to Fulton Savings Bank. "You" refers to each signer on an account. The term "business days" means Monday through Friday, excluding Saturday, Sunday and Federal holidays.

Express Online Banking can be used to access Fulton Savings Bank accounts. Each of your Fulton Savings Bank accounts is also governed by the applicable account disclosure statements ("Account and Service Agreement").

Accessing Your Accounts with Express Online Banking

Requirements:

To access your accounts through Express Online Banking, you must have a Fulton Savings Bank account and an online password.

A Business, Corporation, LLC, Organization, Estate, and some Trusts must be operating under a federal tax identification number to have access to these accounts. Some DBA's may be the owner's Social Security Number to have access to these accounts.

E-mail:

Sending electronic mail (Mailbox) through Express Online Banking is a way to communicate with the Bank. The Mailbox is provided for you to ask questions about your account(s) and provide general feedback. The Mailbox is accessible after you sign on with your password to a "secure" session of Express Online Banking. To ensure the security of your account information, we recommend that you use the Mailbox when asking specific questions about your account(s).

You cannot use the Mailbox to initiate transactions on your account(s). For banking transactions, please use the appropriate functions within Express Online Banking or call the Express Banking Line at 1-877-817-6980.

Fees:

There are no monthly or transaction fees for accessing your account(s) through Express Online Banking. Please note that your online service provider may assess fees.

New Services Policy:

Fulton Savings Bank may, from time to time, introduce new online services. We will notify you of any new services. By using these services when they become available, you agree to be bound by the rules communicated to you concerning these services.

Benefits of Using Express Online Banking:

With Express Online Banking, you can manage your personal or small business accounts from your home or office on your personal computer. You can use Express Online Banking to:

  • View account balances and review transaction history.
  • Transfer money between accounts. (As noted in the Account and Service Agreement).
  • Set up automatically to use the Telephone Banking Line for transfer services in the event the Internet Banking is not available.
  • Pay bills to any merchant, institution or individual.
  • Communicate directly with Fulton Savings Bank through E-mail.

Terms and Conditions

The first time you access your Fulton Savings Bank accounts through Express Online Banking you agree to be bound by all the terms and conditions of this Agreement and acknowledge your receipt and understanding of this disclosure.

Your Online Password:

Upon enrollment, you will be sent an email confirmation with a temporary password or password formula that will give you access to your Fulton Savings Bank accounts for Express Online Banking access. You agree to access Express Online Banking as soon as possible in order to select a unique password. Before you use the service, you should read this Agreement and any other instructions we may send you. This password can be changed within Express Online Banking using the options button. The password will expire every 120 days, you will be prompted to change the password at that time. Fulton Savings Bank will act on instructions received under your password. For security purposes, it is recommended that you memorize this online password and do not write it down. You are responsible for keeping your password, account numbers and other account data confidential.

Second Layer Logon Security:

As per government regulations, we have 24/7 account protection in place. Your logon information will be authenticated the first time you logon. Once you logon for the first time, expect to be prompted to enter additional security questions that only you will know the responses. Payment Account:

Although there are no fees for accessing your accounts through Express Online Banking, you may be asked to designate a payment account for selected services. You agree to pay promptly all fees and charges for services provided under this Agreement, and authorize us to charge the account that you have designated as the payment account or any other account for the fees.

If you close the payment account, you must notify Fulton Savings Bank and identify a new payment account for the selected services. Additionally, if you close all Fulton Savings Bank accounts, you must notify Fulton Savings Bank Customer Service to cancel Express Online Banking services.

Your online access may be canceled at any time without prior notice due to mismanagement of your accounts. In order to reinstate your services, you must call Express Online Banking Customer Service at 315-592-3159 or 315-592-3116 between the hours of 8:30 a.m. and 4:30 p.m. Monday through Friday.

If you do not access your Fulton Savings Bank accounts through Express Online Banking for any (1) one year period, Fulton Savings Bank reserves the right to disconnect your service without notice. Please note that your bill payment information will be lost if you are disconnected.

You agree to be responsible for any telephone charges incurred by accessing your Fulton Savings Bank accounts through Express Online Banking.

If you wish to cancel any of the Express Online Banking services offered through Express Online banking, please contact Fulton Savings Bank Express Online Banking Customer Service at 315-592-3159 or 315-592-3159 between the hours of 8:30 a.m. and 4:30 p.m. Monday through Friday or email cancellation instructions to expressonlinebanking@fultonsavings.com . or mail to Fulton Savings Bank 75 South First St. Fulton, NY 13069.

Our Liability:

Except as specifically provided in this Agreement or where the law requires a different standard, you agree that neither we nor the service providers shall be responsible for any loss, property damage or bodily injury, whether caused by the equipment, software, Fulton Savings Bank, OR by Internet browser providers such as Netscape (Netscape Navigator browser) and Microsoft (Microsoft Explorer browser), OR by Internet access providers OR by Online service providers OR by an agent or subcontractor of any of the foregoing. Nor shall the service providers or we be responsible for any direct, indirect, special or consequential, economic or other damages arising in any way out of the installation, use or maintenance of the equipment, software, the Online Financial Services, or Internet browser or access software.

Overdrafts: Order of Payments, Transfers, Bill Payments and Other Withdrawals

If your account has insufficient funds to perform all electronic funds transfers (ATM withdrawals, pre-authorized transactions, Express Online Banking transfers and bill payments, etc.) that you have requested for a given business day, then:

  1. Certain electronic funds transfers involving currency disbursement, like ATM withdrawals, will have priority, and;
  2. The electronic funds transfers initiated through Express Online Banker may result in an overdraft of your account. In addition, you will be charged the same overdraft charges that apply to your account.

Transfer of Funds Agreement:

As used herein, "Bank" refers to Fulton Savings Bank and "Customer" means a person receiving authorization to use the personal computer (PC) and/or Telephone Banking Line and Personal Identification Number (PIN) as an accepted access device which permits the use of the same to initiate funds transfer transactions through a PC and/or Telephone. This agreement will also allow the Telephone Banking service to be set up automatically with the accounts that were selected for the Internet Banking service "Transfer" capability in the event that one system is not accessible. By use of the PC, Telephone and PIN, Customer(s) agree to abide by the following rules and regulations:

  1. The Bank is hereby authorized to debit or credit the authorized accounts, which now stand in the name of Customer and which shall be maintained by Customer at all times with sufficient available balances to cover all withdrawals according to transactions selected by Customer through use of PC or Telephone. Overdrafts will not be permitted, including any existing agreement with the Bank to cover overdrafts with a Line-of-Credit Agreement.
  2. Customer hereby requests the funds transfer service via PC and/or Telephone for the accounts indicated. In order to qualify for the funds transfer service via PC and/or Telephone, Customer understands that he/she must be an owner or co-owner on all accounts identified and Businesses must have the same Fed ID.
  3. The Bank herewith has provided to Customer all required documentation disclosing rules and regulations as outlined by the Laws of the State of New York or Federal Law when applicable.
  4. Customer may choose to limit access by electronic means to one or more of their accounts. The amount and type of transactions which Customer shall be authorized to perform by use of the PC and/or Telephone in any period shall be determined by the Bank from time to time at its discretion. Customer shall be notified via e-mail prior to the Bank instituting any changes.
  5. Customer will receive an e-mail confirmation with the ID designated when registered and a temporary password to access internet banking. Customer will receive a temporary password via e-mail. Customer will be prompted to change the password after entering the temporary password. Customer shall at all times, (a) safely keep the Password and not permit any other person to use it, (b) not disclose the Password or otherwise make it available to any person, (c) use the Password as instructed and for purposes authorized by the Bank and not permit any unauthorized use thereof not withstanding any other provisions of these rules and regulations or others disclosed to Customer. If at any time Customer believes their Password has been compromised, Customer shall change it as soon as possible. If Customer forgets his/her Password, Customer shall notify the Bank immediately and request the Password be re-established.
  6. Customer will use the PIN as instructed for first-time users while accessing the Telephone Banking Line for the first time. Customer will be prompted to change the PIN after accessing the Telephone Banking Line for the first time. The PIN should be 4 digits only. If Customer forgets his/her PIN, Customer shall notify the Bank immediately and request the PIN be re-established. NOTE: The PIN for the Telephone Banking service and the Password for the Internet Banking service are not the same for the initial first use of each service.
  7. These rules and regulations supplement all other agreements between Customer and Bank, and rules and regulations with respect thereto, which may govern the Customer's Checking Account, Savings Account, and any other accounts with the Bank.
  8. Upon default by Customer in the performance of the obligations contained in this agreement or any other obligations to the Bank or in the event of death, assignment for the benefit of creditors or the commencement by or against Customer of bankruptcy proceedings, the Bank may immediately terminate this Agreement and all sums withdrawn by Customer hereunder shall be deducted from the accounts listed above or if said accounts are insufficient, then from any other accounts, deposits or property of Customer in the hands of the Bank.
  9. Customer may terminate this Agreement by submitting a request in writing or by e-mail to the Bank.
  10. The term Customer as used herein shall be deemed to include all parties and their liability shall be joint and several.
  11. The Bank has the right to revoke this agreement at any time with or without cause or with or without notice. The closeout of an account immediately terminates the funds transfer service associated with that account.
  12. NOTE: CDs and IRAs do not qualify for the Funds Transfer service.

Hours of Accessibility:

You can access your Fulton Savings Bank accounts through Express Online Banking seven days a week, 24 hours a day. However, at certain times, some or all of Express Online Banking may not be available due to system maintenance. You will be notified Online when this occurs.

One-time transfers initiated through Express Online Banking are immediately posted to accounts. Future-dated transfers are processed at 11:00 a.m on the scheduled business day. Our business days are Monday through Friday, Saturday, Sunday, and Federal Holidays are not included as a business day.

Computer Requirements:

Express Online Banking requires the use of certain software, a computer, an Internet Service Provider (ISP), a modem (at least 28,800 baud is recommended), and Browser software which supports 128 bit encryption, Secure Socket Layer 3.0 (SSL). For best results, we recommend Microsoft Internet Explorer 6.0, or Netscape Navigator 6.2.3 or higher.

In this Agreement, the computer and modem you need to use the software are collectively referred to as your "Computer". You are solely responsible for the selection, installation, maintenance and operation of your Computer. Your Computer must be compatible with our operations in order to access your accounts or to use our bill pay service. We are not responsible for any errors or failures from any malfunction of your Computer or your software, and we are not responsible for any computer viruses or related problems that may be associated with the use of Express Online Banking. WE DISCLAIM ALL WARRANTIES REGARDING YOUR EQUIPMENT AND YOUR SOFTWARE, EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

Additional Terms and Conditions:

Obtaining Account Balance and Transaction History - You can obtain balance and transaction history on all eligible accounts. Current balance and activity information is available as of the close of the previous business day.

Transferring Funds - The number of transfers from a savings account is limited as described in the applicable Deposit Agreement and Disclosure. If a hold has been placed on deposits made to an account from which you wish to transfer funds, you cannot transfer the portion of the funds held until the hold expires.

Bill Pay Service

Using the Service:

The Express Banking Online Bill Pay Service allows you to schedule bill payments through Express Online Banking. You can schedule, at your option, for the payment of your current, future and recurring bills from any of your Fulton Savings Bank checking accounts. There is no limit to the number of payments that may be authorized. You may pay any merchant or individual through the use of Express Online Bill Payment Service. By furnishing us with the names of payees/merchants, you authorize us to follow the payment instructions to these payee/merchants that you provide us through Express Online Banking. When we receive a payment instruction (for a current or future date), we will remit funds to the payee on your behalf from the funds in your selected checking account. When Express Online Bill Payment Service receives a payment instruction, you authorize it to charge your checking account and remit funds on your behalf so that the funds arrive as close to the business day designated by you as reasonably possible. While it is anticipated that most transactions will be completed on the exact day designated, it is understood that due to circumstances beyond the control of Express Online Bill Payment Service, particularly delays in handling and posting payments slow-responding companies or financial institutions, some transactions may take a day or even a few days longer.

For this reason, it is recommended that all payments transfers be scheduled to at least (5) seven business days before the actual due date, not the late date. Express Online Bill Payment Service will use its best efforts to process all your payments properly. However, Express Online Bill Payment Service shall incur no liability if it is unable to complete any payments initiated by you through Express Online Banking bill pay services.

You have the right to stop or change any scheduled payment. You must cancel the payment by no later than 11:59 p.m. Eastern time, the night before the scheduled payment date, by using the DELETE function on the Express Online Banking "Payment Center" screen.

Fulton Savings Bank reserves the right to terminate your use of Express Online Banking bill payment service in whole or part, at any time without prior notice.

If, for any reason, you should ever wish to cancel Express Online Banking bill payment services, we strongly suggest that you cancel all future bill payments at the same time that you cancel your service, either by deleting those payments yourself using Express Online Bill Payment or calling Fulton Savings Bank's Customer Service at 315-592-3159 or 315-592-3116 between the hours of 8:30 a.m. and 4:30 p.m. This will ensure that future payments and transfers made by you will not be duplicated. We will automatically delete all outstanding payment orders (all individual payments and all recurring payments) once we have been notified that your service has been terminated. We will continue to maintain your accounts until you notify us otherwise.

Agreement:

If you elect to utilize the Express Online Bill Payment Service, you direct Fulton Savings Bank to make payments from your designated Checking Account to the Payees you choose in accordance with this Agreement. The terms and conditions of this Agreement are in addition to the Checking Account Agreements and other disclosures and documents in effect from time to time governing your Checking Account.

You agree to have available and collected funds on deposit in the Checking Account you designate in amounts sufficient to pay for all Bill Payments requested as well as any other payment obligations you have to us. We reserve the right, without liability, to reject or reverse a Bill Payment if you fail to comply with this requirement or any other terms of this Agreement or the Account Rules. If any payment is rejected or reversed by us, you must resubmit it using the one-time process.

If you do not have sufficient funds in the Account, payment will be processed against the automatic Overdraft Protection program (OOPS) if you are eligible, and you will be charged the service fee. Any Bill Payment can be changed or canceled, provided you access the Service before the cut-off time (12:00 a.m.) on the business day prior to the business day the debit on the Bill Payment is to be made.

Accessing the Service:

Express Bill Pay is a function of the Online Banking service. You can access the service once you sign on to Online Banking.

Setting up Payees and Payments:

Enrollment is processed through Online Banking. Once you have signed on to the Online Banking, Click on the Bill Payment tab. After you have set up your initial Payees and Payments, you may add, delete, or revise them by accessing the Service and entering the appropriate information.

We reserve the right to refuse the designation of a Payee for any reason. We are not responsible if a Bill Payment cannot be made due to incomplete, incorrect, or outdated information provided by you regarding a Payee.

Bill Pay Fees:

Express Online Banking bill pay service is free.

You may place a stop payment on bill payments. Applicable fees will apply. Refer to the current schedule of fees.

Bill Pay Guarantee:

If a properly scheduled payment is not received and posted on time by the payee, we will attempt to have any late fees or assessed finance charges removed. (Finance charges are calculated based on your payment amount rather than your entire balance.) If the payee is unwilling or unable to remove them, we will pay the fees and finance charges directly to the payee. In addition, we will attempt to have your account noted appropriately to ensure that the situation does not negatively impact your credit rating.

The Payment Guarantee applies to late fees and/or finance charges associated with the late posting of a payment, provided that the following conditions are met:

  1. The payment was scheduled to be delivered on or before the due date of your bill, excluding any grace periods. The one exception to this guideline is that mortgage payments may be scheduled so that the payment is sent on or before the due date, excluding grace periods. For example, a mortgage payment due on July 1st, with a 15-day grace period, must have a "Send On" date no later than July 1st.
  2. The payment amount did not exceed $25,000.00
  3. The payment was not made to an excluded payee. These payments are permitted but not guaranteed:
    • Payments that failed due to insufficient funds or other reasons
    • Payments to payees located in the Armed Forces Postal Codes such as AE & AP
    • Payments to settle securities transactions
    • Payments to payoff special or delayed financing for purchases
    • Payments to credit counseling agencies who pay creditors on your behalf
    • Court-ordered payments such as alimony, child support, speeding tickets, etc.
    • Tax entities
    • Collection agencies
  4. The payment was not made to a prohibited payee. Payments to the following payees are not permitted through this service:
    • Payments to payees outside of the United States
  5. The information supplied by you is correct (payee name and address, your name and account number as it appears on the payee's records).

Excluded Merchants:

Payees are eligible for payment but are not guaranteed through this service include governmental agencies including but not limited to the Internal Revenue Service, all state and local tax authorities, collection agencies, as well as recipients of court-ordered payments like child support or alimony. Any organizations or individuals outside of the United States are also excluded. Payments to government agencies for utilities such as water are permitted.

If a payment is made to an excluded merchant, the Payment Guarantee does not apply and this service will not be liable for any fees or other penalties associated with that payment.

Payees in the Armed Forces Postal Codes

You can schedule payments to Payees that are located in the Armed Forces Postal Codes such as Armed Forces America (AA) and Armed Forces Europe (AE). While the United States Post Office identifies the Armed Forces Postal Codes within the range of standard domestic mail, the mail that is delivered to these Postal Codes are subject to delays at the military bases. Therefore, payments to Payees in the Armed Forces Postal Codes are not covered under the Payment Guarantee.

Expedited Payments Guarantee:

If a Properly Scheduled Expedited Payment (defined below) is not received and posted by the payee as of the scheduled payment date, you will not be responsible for any Penalties (defined below) that arise due to the failure of such payment to post on the scheduled date and we will refund you the service fee associated with such payment. We will first attempt to have any such Penalties removed, and if the payee is unwilling or unable to remove them, we will pay the fees and finance charges directly to the payee. In addition, we will attempt to have your payee account noted appropriately to ensure that the situation does not negatively impact your credit rating.

"Penalties" are defined as late fees or finance charges that are assessed on the Properly Scheduled Expedited Payment amount that did not post on the scheduled payment date, not those based on your total outstanding balance.

A "Properly Scheduled Expedited Payment" is defined as a payment that:

  1. was made from an account that has sufficient funds for the payment and any fees associated with the payment;
  2. was scheduled to be delivered on or before the due date of your bill, excluding any grace periods. The one exception to this guideline is that mortgage payments may be scheduled so that the payment is sent on or before the due date including grace periods. For example, a mortgage payment due on July 1st, with a 15-day grace period, must have a "Deliver By" date no later than July 15th.;
  3. the service indicated is deliverable on or prior to the applicable due date;
  4. was not made for any of the following types of transactions:
    • Payments that failed due to insufficient funds or other reasons
    • Payments to settle securities transactions
    • Payments to payoff special or delayed financing for purchases
    • Payments to credit counseling agencies who pay creditors on your behalf
    • Payments to payees outside of the United States
    • Court-ordered payments such as alimony, child support, speeding tickets, etc.
    • Tax entities
    • Collection agencies
  5. the information supplied by you is correct (payee name and address, your name and account number as it appears on the payee's records);
  6. does not cause you to exceed any applicable risk management limits;
  7. was scheduled when the system was available; and
  8. the payment complies with the payee's policies.

Liability:

You are liable for all transactions you or your authorized users make, even if that person exceeds his or her authority. You will be responsible for any Bill Payment request you or an authorized user on your account makes that contains an error or is a duplicate of another Bill Payment. We are not responsible for your acts or omissions or those of any other person, including, without limitation, any transmissions communications facility, and no such party shall be deemed to be our agent. In any event, we will not be liable for any special, consequential, incidental or punitive losses, damages, or expenses in connection with this Agreement or the Express Bill Pay Service, even if we have knowledge of the possibility of them. We are not liable for any act, failure to act, or delay in acting even if it is caused, in whole or in part, by any cause beyond our reasonable control.

Stop Payment Policy:

If you request that a Stop Payment be placed on a Bill Payment within twenty-one (21) calendar days of the date your account is debited, we will impose a Stop Payment fee. If a Payee whom you have designated does not receive electronic payments, the payment will be submitted via paper check on your behalf. You may not place a stop payment on a payment that has been processed entirely by electronic means. You may contact the Express Online Banking Department in order to request an inquiry be placed on an electronic payment for posting research within 10 business days.

General Terms

Changes to Charges, Fees or Other Terms:

We reserve the right to change the charges, fees or other terms described in this Agreement. However, when changes are made to any fees or charges, we will notify you Online, or send a notice to you at the address shown on our records, or send you an electronic mail message (E-mail). The notice will be posted or sent at least thirty (30) days in advance of the effective date of any additional fees for online transactions, or of any stricter limits on the type, amount or frequency of transactions or any increase in your responsibility for unauthorized transactions, unless an immediate change is necessary to maintain the security of the system. If such a change is made, and it can be disclosed without jeopardizing the security of the system, we will provide you with electronic or written notice within thirty (30) days after the change. As always, you may choose to accept or decline changes by continuing or discontinuing the accounts or services to which these changes relate. We also reserve the option, in our business judgment, to waive, reduce or reverse charges or fees in individual situations. The most current Account and Service Agreement govern changes to fees applicable to specific accounts.

Disclosure of Account Information:

You understand that in addition to information furnished pursuant to legal process, some information about your accounts may automatically be disclosed to others. For example, the tax laws require disclosure to the government of the amount of the interest you earn, and some transactions, such as certain large currency and foreign transactions, must be reported to the government. The Bank may also provide information about your account(s) to persons or companies the Bank believes would use the information for reasonable purposes, such as when a prospective creditor seeks to verify information you may have given in a credit application or a merchant calls to verify a check you have written. In addition, the Bank routinely informs a credit bureau when accounts are closed by the Bank because they were not handled properly. The Bank may also seek information about you from others, such as a credit bureau, in connection with the opening or maintaining of your account. You authorize these transfers of information.

Questions or Error Correction on Express Online Banking Transactions:

In case of questions or errors about Express Online Banking funds transfers through Express Online Banking involving your account, here is what you should do:

  • E-mail expressonlinebanking@fultonsavings.com or;
  • Telephone Fulton Savings Bank at 315-592-3159 or 315-592-3116 between the hours of 8:30 a.m. and 4:30 p.m. or;
  • Write Fulton Savings Bank at 75 South First St., Fulton, NY 13069, as soon as you can if you think your statement or transaction record is wrong, or if you need more information about a transaction listed on the statement or transaction record, we must hear from you no later than sixty (60) days after we have sent the first statement on which the problem or error appeared. If you notify us verbally, we will require that you send us your complaint or question in writing within ten (1O) business days.
  • Tell us your name and account number
  • Describe the error or the transaction you are unsure about, and explain why you believe it is in error or why you need more information.
  • Tell us the dollar amount of the suspected error.
  • For a bill payment, tell us the checking account number used to pay the bill, payee name, date the payment was sent, payment amount, reference number, and payee account number for the payment in question.
  • Here's what we'll do:

    We will tell you the results of our investigation within ten (10) business days, or twenty (20) business days in the case of point of sale purchases, after we hear from you and will correct any error promptly. If we need more time, however, we may take up to forty-five (45) days, or ninety (90) days in the case of point of sale or international transactions, to investigate your complaint or question. If we decide to do this, we will credit your account within ten (10) business days, or twenty (20) business days in the case of point of sale or international transactions, for the amount you think is in error, so that you will have the use of the money during the time it takes us to complete our investigation. If we ask you to put your complaint or question in writing and we do not receive it within ten (10) business days, we will not credit your account. If we determine that there was no error, we will send you a written explanation within three (3) business days after we finish our investigation and debit the amount of the error that we previously credited. You may request copies of the documentation used to complete our investigation.

    If we do not complete a transfer to or from your Fulton Savings Bank account on time or in the correct amount according to our agreement with you, we will be liable for your losses or damages. However, there are some exceptions. We will not be liable, for instance:
  • If, through no fault of ours, you do not have enough money in your account to make a transfer.
  • If a legal order directs us to prohibit withdrawals from the account.
  • If your account is closed or if it has been frozen.
  • If the transfer would cause your balance to go over the credit limit for any credit arrangement set up to cover overdrafts.
  • If you, or anyone you allow, commits any fraud or violates any law or regulation.
  • If any electronic terminal, telecommunication device or any part of the electronic fund transfers system is not working properly.
  • If you have not provided us with complete and correct payment information, including without limitation the name, address, account number, and payment amount for the payee on a bill payment.
  • If you have not properly followed the instructions for using Express Online Banking.
  • If circumstances beyond our control (such as fire, flood or improper transmission or handling of payments by a third party) prevent the transfer, despite reasonable precautions taken by us.

eStatments:

If you would like to receive your monthly statement electronically and you are currently an Express Online Banking customer, you may sign up for this service at no cost by logging in and clicking on the e-Statement tab at the top of the page. An e-Statement Agreement will be presented for your review and acceptance. In order to receive your statement in this manner, you will need to have access to the Internet, have a current e-mail address and have Adobe Acrobat Version 5.0 or better, which you may download free of charge at http://www.adobe.com/products/acrobat/readestep2.html.

Other General Terms:

Other Agreements - In addition to this Agreement you agree to be bound by and will comply with the requirements of the applicable Account and Service Agreement, the Bank's rules and regulations, the rules and regulations of any funds transfer system to which the Bank belongs, and applicable State and Federal laws and regulations. We agree to be bound by them also.

If any provision of this Agreement is found to be unenforceable according to its terms, all remaining provisions will continue in full force and effect. The headings in this Agreement are for convenience or reference only and will not govern the interpretation of the provisions. Any waiver (express or implied) by either party of any default or breach of this Agreement must be in writing and shall not constitute a waiver of any other or subsequent default or breach. You may not assign this Agreement. This Agreement is binding upon you heirs and Fulton Savings Bank successors and assigns. Certain of the obligations of the parties pursuant to this Agreement that by their nature would continue beyond the termination, cancellation, or expiration of this Agreement shall survive termination, cancellation, or expiration of this Agreement. This Agreement constitutes the entire agreement between you and Fulton Savings Bank with respect to the subject matter in this Agreement and there are no understandings or agreements relative to the Express Online Banking and Bill Pay service, which are not fully expressed herein. We may at any time (subject to legal restriction) amend this Agreement. We will notify you of any amendment to this agreement at least 30 days prior to the effective date of the amendment. Express Banking Online and Bill Pay service will be governed by the Agreement as amended.

Fulton Savings Bank Reserves the Right to terminate this Agreement - The Bank reserves the right to terminate this Agreement and your access to Express Online Banking, in whole or in part, at any time without prior notice.

Protecting Your Account

Preventing Misuse of Your Account:

Your role is extremely important in the prevention of any wrongful use of your account. You must promptly examine your statement upon receipt. If you find that your records and ours disagree, you must immediately call Fulton Savings Bank 315-592-4201.

Protecting Personal Information - In addition to protecting your account information, you should also take precautions to protect your personal identification information, such as your driver's license, Social Security Number, etc. This information by itself or together with information on your account may allow unauthorized access to your account(s). It is your responsibility to protect personal information with the same level of care that you protect your account information.

Taking Care of Your online Password - The password that is used to gain access to Express Online Banking should also be kept confidential. For your protection we recommend that you change your online password regularly. It is recommended that you memorize this online password and do not write it down.

You are responsible for keeping your password, account numbers and other account data confidential. If you believe that your online password may have been lost or stolen, or that someone has transferred or may transfer money from your account without your permission, notify Fulton Savings Bank Customer Service at once at 315-592-3159 or 315-592-3116 between the hours of 8:30 a.m. and 4:30 p.m. Monday through Friday.

Unauthorized Transactions in Your Fulton Savings Bank Accounts:

Notify us immediately if you believe another person has improperly obtained your online password. Also notify us if someone has transferred or may transfer money from your account without your permission, or if you suspect any fraudulent activity on your account. Only reveal your account number to a legitimate entity for a purpose you authorize (such as your insurance company for automatic payments). If your online password has been compromised and you tell us within two (2) business days after you learn of the loss or theft, you can lose no more than $50 if someone used your online password without your permission to access a Fulton Savings Bank deposit account. If you do NOT tell us within two (2) business days after you learn of the loss or theft, and we could have stopped someone from taking money without your permission had you told us, you could lose as much as $500.

Also, if your statement shows withdrawals, transfers or purchases that you did not make or authorize, please notify us immediately. If you do not notify us within sixty (60) days after the statement was sent to you, and we could have stopped someone from taking money if you had told us in time, you may not get back any money lost after the sixty (60) days. If extenuating circumstances, such as a long trip or hospital stay, kept you from telling us, the time periods in this section will be extended.
